Prenuptial/Postnuptial Agreement

There are two different Contracts that will help protect you now and in the Future. A Prenuptial Agreement is a Contract between you and your spouse that is created prior to marriage. A Postnuptial Agreement is a Contract between you and your spouse that is created during your marriage.

Prenuptial Agreement

You are getting married and the last thing you are thinking about is a Prenuptial Agreement, but do you need a Prenuptial Agreement? A Prenuptial Agreement can protect you especially if you have children from a previous marriage, own a business or bring a financial portfolio to the marriage.

We weigh the benefits and risks of having a Prenuptial Agreement against that of not having a Prenuptial Agreement. Remember, in the case of a Divorce without a Prenuptial Agreement your rights may be decided by a Judge or Jury instead of you.

Postnuptial Agreement

You are already married and due to life changing events you want to protect yourself and your family in the case of a Divorce or a Separation. A Postnuptial Agreement can protect you especially if you have children, own a business or want to help protect yours and your family's financial future.

Postnuptial Agreements have become public due to high profile cases like that of Tiger Woods. A Postnuptial Agreement may help resolve issues in the marriage by limiting sources of disagreement like finances, assets, children and chores. Postnuptial agreements can be used after an incident in the marriage to control behaviors like adultry, over spending, child’s education and employment.

A Postnuptial Agreement may be necessary for you if the financial status of either spouse changes due to things like a career change, inheritance, change in investment income, and selling a business.

Another reason to create a Postnuptial Agreement is if the financial status of either spouse changes after their wedding. Changes in a career, receiving an inheritance, experiencing a change in investment income, selling a business, etc. are all valid reasons to want a Postnuptial Agreement.
